Speeding Ticket Question

Ok, Where my law people at! Have a question.

I got a speeding ticket last year in early September. I was going 100+ and after all the court dates I was put on 12 months probation January 4th, 2012. Couldn't get any more speeding tickets in that 12 months. Had to do community service as well.

All is well until I got a speeding ticket going 82 in a 65 last night. The court date isn't until December 11. My probation ends January 4. I plan to appeal the ticket considering there was an 18 wheeler right beside me going the same speed as me. I might not win the appeal but my record needs to be clean when I get off probation so the judge can throw away my first ticket.

Is this possible? Is there anyway my probation officer can see this ticket?

Is your family friends with any lawyers? If not it might be worth paying one for a short counseling session to see what options you have. You might get some good ideas here from some of the guys but it wont compare to what a local lawyer can tell you.

When the officer pulled you over did you admit to speeding? They always ask if you know how fast you were going. If you reply "maybe a little bit over" or anything similar you just admitted your guilt and they will most likely put that in the report to seal the deal. What was so important that you needed to travel over 80mph?

Of course they can see the ticket. That's how they make their money. You're going to lose your license for at least a while if you don't get a lawyer, and maybe even if you do.

If you could just get your ticketed speed dropped from 82 to 79, that alone would help. Points appear on your license in Georgia when you get a ticket for 15+ mph over the limit.

Being on a limited permit, you WILL have that limited permit revoked if you simply pay the speeding ticket or otherwise plead guilty to the infraction. I don't mean to make this sound more serious than it is. These are certainly serious matters, but all of them can be dealt with in a way that I think you could probably live with, but it is CRUCIAL that you consult an attorney about the situation as soon as possible to start sorting out the various issues.

I didn't admit to speeding at all! I told the officer I was looking at the speedometer and I was within the speed limit. I was right next to a 18 wheeler. I wasn't even in a rush of any sort. I was just trying to drive back to the house.

It doesn't matter what you told the officer dude. You weren't recording the conversation and he didn't have to write it in his notes and probably didn't. All he would have written was how fast he said you were going and maybe something about you lying to him or displaying a bad attitude.

I know you were right next to an 18 wheeler and were trying to do the safest thing, but in most instances, that doesn't matter to a cop or a judge. And I hate to say this, but it's true, the fact that you're young, black, and have a pretty impressive prior is not going to help either. The cop was most likely making his impressions of you based on profiling, and giving him a BS answer like you were looking at your speedometer when you knew you were speeding probably didn't help. The isn't concerned with what any motorist on the street is doing except YOU, unless you can prove they put you in a position where it was impossible for you to avoid having a problem (ie, being rear ended or being run off the road - you can't get a left of center violation or reckless operation charge if you are run off the road).

It's also likely that the judge is going to look at your prior and feel like you got off way too easy for doing 100+ on any road and want to punish you more severely this time since they will perceive you did not learn your lesson after being given a break.

The short story behind all this is - you need a lawyer.

You can try deferring the trial date until after your probation, but it probably won't matter because if the judge wants to get you, she'll get you because the offense took place during your probation. Trial date is irrelevant and will only help if your attorney has a good relationship with either the prosecuting attorney or the judge.

But this is why you need an attorney. Most likely, the prosecuting attorney will not take you seriously if you can find the time to figure out how to represent yourself and you will not be able to get a good deal. On the other hand, if you find an attorney who has a good relationship with the prosecuting attorney and the judge (and who is also very intelligent and legally savvy), he will be much more likely to be able to make a deal.

Criminal convictions can make life unnecessarily hard on you, especially when it's for something BS like speeding. No company asks you why you got a misdemeanor or felony, they just ask if you got one. The background checks they perform will typically not give them an incredible level of detail about what exactly happened to you... it will just give you the charges. Most employers who see a criminal misdemeanor are not going to assume you were speeding, they'll probably assume assault, robbery, or something like that.

Again I say, you need a lawyer.

BTW, how did you get such a late court date? Did you waive your right to a speedy trial? Technically you're supposed to have one within 30 days unless you submit a motion to waive that right, and if you didn't do that, your attorney may be able to argue your Constitutional right to have a speedy trial was violated making the case moot.

Also, were you arrested? And are you scheduled to be arraigned? Both of those are important points.

1. I didn't get arrested.

2. The judge for my first speeding ticket and my probation officer are the only people that know about that ticket. I don't think any other judge can see it. The judge didn't turn the paper work in because if he did he knew my license would be automatically suspended.

3. It just worked out that way that the trial is December 11. I got my last speeding ticket September 11. My probation started January 4.

4. I'm hoping I can just fight the charge until after January 4. This should be easy. Hopefully, January 4th the first judge throws away my old speeding ticket and then he or the probation officer won't ever mess with me again.

Update: I'm going to court December 11 just to get the judge to bump down the speed by 2mph so it wont hurt my insurance. (this court is only 20 miles from me.)

But here is one situation. Because I got this last ticket the judge from the ticket I got Sep 2011 wants me to take a Risk Reduction Class (300$). I'm debating if I want to bargain with the judge (would have to drive over 100 miles) so I can do an alternative or just pay the 300$ and charge that weekend to the game.

I mean I have 300$ but damn that is an expense for me as I have no job.

I got a speeding ticket September 2011. I was going 110 in a 55. So I went to court on January 2012. Judge said I needed to pay 900$ speeding fine, 12 months probation, 120 hours of community service and I couldn't get any more speeding tickets while on probation. If I obey all this then he wouldn't forward the ticket to the DMV.

In August 2012 I got a ticket for going 82 in a 65 so I violated this probation. When I told my probation officer she told me to come to court and deal with the judge. The judge said he would give me one more chance since I rarely even get any traffic tickets. He told me that all I have to do is take a Risk Reduction Course.

So I'm like cool thats wasup. Thinking it would be a 75$ course or something. I then realize that this course is a 292$ course and it's 20 hours. I don't want to spend the $ or waste my time. So I was thinking is there a way I can just go to court and he just let me do 20 more community service hours or something or is that just out the question. (If I ever talk to the judge I have to drive 100+ miles). Which is a no go.

What you think I should do? I'm leaning towards just paying the fine and charging a weekend to the game but if I can save some money it would be great for a person who is still in college even though I'm graduate post-grad in 2 weeks.

I already paid the 900$ for the original ticket, already did 120 community service hours, and as of now served 11 months probation.

I'd say you DESERVE to lose your license,

and you;ll be lucky if you don't have to pay a HUGE fine, and maybe even do a bit of jail time. Apparently, you just don't get the message, dude. Even when you KNOW that a ticket is going to cost you dearly, you just CAN'T keep your lead foot off of the gas pedal. well, it's not going to be on any pedals for a year or more, cause you're going to lose your license, period. Lawyer might shorten the span you're out of pocket, but I doubt that his fee will be worth it to you.

Well if you clearly read the thread you would realize that all I have to do is take this 300$ course and the super speeding ticket will be thrown in the trash.

Just don't want to pay the 300$ or take a three day weekend class. I don't have time like that to waste on the weekend.

There's a lot of talk here about beating a ticket, and very little about the danger you keep putting others in with your reckless behavior.

You and I have always gotten along well here at SS, but I personally would throw your ass in jail for a while in the hope that you would start to understand that consequences for your actions are real and that you have no right to endanger innocent people. You're going to kill someone someday unless you grow up.

To be real I don't understand all the heat I'm getting here. I went 110 in a 55 two years ago (Not to mention in a back road South of Georgia where I didn't see a car for nearly half an hour). Apart from that I went 82 in a 65 in Atlanta one year later where everyone is going over the speed limit already.

But I guess I'll just charge this 300$ to the game and get this over with. If I speed I go with the flow now it is because I'm going with the flow (which means the other cars are going over). I guess the reason I don't understand why everyone is so harsh is because I've never gotten into an accident in my life.

What about the emergency workers who have to risk their lives on the road as they shovel your remains off the highway and tow your car away? How about that van carrying a family that comes around the turn that you start losing control at?

It's one thing to be travelling along with everyone else significantly above the speed limit. I understand that some stretches of road have that "culture" or understanding where everybody just does it, and even the cops don't bother you unless you're travelling significantly faster than everyone else.

But when we get into 90 mph and above this is simply putting too many people at risk. You're only 22, but not too young to understand this, unless of course it's all about you.

Judge Nismo, I'd like to request a sentence of 2 months in the slammer for this young man. Then we can show him videos the devastation that kids just like him rained down upon innocent families 24/7.

I will relent & give him 72 hours to help him solidify the reality of consequences. I will also require a written case study of 10 families whose lives have been turned upside down by a speeding driver.

Seriousely this irritates me because he's the kid you see out on the road taking chances with your life in order to gratify his need for a thrill. I detest the thought of putting innocent people in danger.
