I've always been curious about this.

How come porn is legal to make, while prostitution is illegal?

They are both acts of paying for sex. Nobody has ever been ever to answer this.

Prostitution is "The act or practice of engaging in sex acts for hire". This means that one would pay directly to have sex with them. This is different from pornography for a couple reasons.

A. Porn is entertainment purposes only. None of the porn stars pay eachother for sex, they recieve money from the sales or contract.
B. Porn industries have strict guidelines from what I hear. Regular STD testing and health screens are supposedly a common practice among the actors.
C. Porn is a movie. It's planned out, scripted, edited etc. The whole 9 yards. Prostitution is a "I'll pick you up on the corner, you'll charge me a lot of money to possibly get AIDs, and we'll bang."

It's a religious matter (just like most non-sensical laws). Back in the day, prostitution was actually a well respected profession. There were even temple prossies who were a very big part of "pagan" celebration and ritual. When the Abrahamic religions gained political power (Chrisianity, Judaism and Islam), they all did their best to convince people that the old ways were wrong and the new ways were the only ones that could possibly be right. Somethings were villified or banned like prostitution, others were incorporated and renamed like Christmas (Yuletide) and Halloween (Samhain). Even knowledge gained by earlier pagans was discredited, for example, were you aware that the ancient Greeks actually knew that the earth was round, they knew it's circumferene to within 2%, they knew the distance to the moon, also within a few percentage figures. But these facts, having been discovered by pagans could obviously not be right, so the general population were told it was wrong and after a few generations it was forgotten until modern times.

The reason that porn is excluded from this idiocy is quite simple, porn wasn't around during the times that vapid religionists were rewriting history and banning things they felt might be a threat to them. Of course, this isn't the only factor involved, but it's by far the most influential in the matter.

Hmmm...interesting topic. Im doing a paper about sex trafficking, prostitution, porn and all that good stuff. This day in age prostitution is pretty jacked up. Yea, it may only be paying for sex but its not like the women get to keep the money they make. Pimps usually control and abuse them. Im not gonna get into everything cause its a waste of time but yea. Ive seen some porns where the women werent into it at all, which is kinda weird and kills it. Porn is in a more controlled enviornment, i guess. Australia has legalized or decriminalized prostitution and a sh*t ton of women are trafficked there. If you want more...i have lots.

Pimps also have "players balls" in las vegas annually to see who the biggest pimp is.

Actually, ask anyone in Nevada or in other countries where prossies are legal and they'll tell you that prostitution is easily taxable. It's still illegal to do it outside of official channels in most of those places, and those places are monitored and regulated by the local government more than any porn studio could ever be. It's perfectly legal for any legal age chick in America to set up a webcam and start cramming fruit in her junk for anyone with a high-speed connection, try taxing that.

For that matter, pot is the same way. In places that it's legal, you still have to buy it through govt. licensed dealers, home growing and street deals are still illegal.

So pot and prostitutes are just as easily taxed as alcohol or porn. So your answer could not be further from the truth, no offense....

Exactly! Mainstream porn makes big money, the fat cats get rich, the tax goes to the government and the people think they live in a liberated society.

But even a high class, vegas style brothel isn't going to draw as much money as porn movies.

Any question that begins "Why do the government...?" ends with the answer: "for money or power!"

If it were about the 1st amendment, women would be controlling how the movies are made and not give a fvck about pleasing men. However, most porns are made with the MALE in mind, made by males, and therefore can't be considered EXPRESSION, since the woman only plays a ROLE she's told to play by the writer/director. Were it expression, she might have a say in what occurs. All she has a say in is doing the film or not doing it.

Porn, the world around, generates so much money that it hasn't been shut down, and 1 can contest the right to protest. Yet many laws, because of the craftiness of lawyers, enable the slip-up of situations that normally shouldn't occur. Corporations have gained so much power and authority, not because they should, but because over 350 cases were brought to the courts by corporations when blacks were freed, and corporate lawyers said "corporations are a person, and should be treated as such." Prior to the freeing of the slaves and 14th amendment, corporations had legal liability THROUGH to the owners and officers, so people today would have thought twice about cooking the books, about defrauding the public, and a host of other illegalities. Just because it is allowable by the 1st amendment, doesn't necessarily make it right or good. Even the 14th has had it's ups and downs.

If they legalized prostitution, would women flock to it? Not really. Would men flock to it? No. Why pay for sex when you can get it near free with someone MUCH cleaner and prettier. Prostitution might be all legal and hunky and dorey and NV, but they also have the bunny ranch, and similar high end brothels that distort the stats. It would be quite unregulated.

Consider that when prohibition went into effect, bath tub gin and speak easys grew up everywhere out of nowhere. The effect of ILLEGALIZING alcohol was worse than ILLEGALIZING drugs. Were drugs legal, society would appear worse off, as people would scrummage to work high. Drug tests would be MORE prevalent, and on the hole, would be a further bain. Throw in the fact that you can chuck WEED anywhere, and it's versatility as a CONSUMER GOOD, and it's probably never going to be widely legalized.

Part of it is consumption and part of it is taxation. People consume porn and booze on a grander scale. Married people, even some purportedly religious people view porn. But fewer people would use the services of hookers, including myself. The larger demand for the service/product, would create devastating consequences, and also hinder the tax base.

Regarding prostitution, the actual crime as spelled out by the statute is soliciting, not specifically prostitution. This makes it easier to arrest the street-walkers. All they have to do is make the offer, and that is the crime. What bugs me is how the cops run sting ops to catch the street-corner girls and their johns, yet the yellow pages still has a giant section of "escort" agencies. It's obvious that escorts are merely prostitutes with a little more sense.

You've got it backwards. The only reason the govt. doesn't make money off of it is because it's illegal. If it was legal, they would make plenty of money from it.

The average cost of a prostitution bust is $2000. The average fine is $1000. So each hooker busted costs taxpayers a grand.

An average large metropolitan area will net 150+ prostitution busts a weekend. There are probably 20-30 cities in the US with similar bust numbers on a given weekend. An average year has 52 weekends in it.

So you could easily estimate that over 200 million dollars a year of taxpayers money is wasted to keep Johns from getting their rocks off. Kinda retarded if you ask me.

Why does it cost $2K just to arrest 1 hooker? Just drive around in an armoured police car, find anyone soliciting, throw them in, give them 2 months without trial.

Frankly, I'd prefer for hookers to be legalised, but controlled severely, so they can't start the next AIDS plague. Frequent government inspections to make sure all the *****s have health check papers, free booths for them to get disease checks, etc.

i seriously doubt those numbers, even considering all hard and soft expenses. the vast majority of busts are wholesale sweeps (e.g. volume "discounts"). on the prostitute side, most of these ho's have been arrested numerous times already. collect them, process them, release, pay a fine. they're out in a couple of hours, maybe overnight. wash rinse repeat.

i don't think prostitutes serve any time at all, unless they've got outstanding warrants or unpaid fines on previous ho'ing activities. basically, in a large metro area, prostitution is already defacto "legal"...a 2nd or 3rd degree misdemeanor...and it's basically "taxed" (e.g. the fine).

on the john side, it's a different story. just as easy to grab the guys in a bust, pretty much the same processing requirements, but a WAY bigger fine.

Yeah, that's the same rationale here. Street prostitution is more dangerous, hookers are likely giving all their money to their pimps or drug habits, and it hurts the reputation of neighbourhoods. Usually, where there is prostitutes, there are also gangs and drug peddelers also lurking around.

So, up here in Toronto Canada, is the same double-standard policy. One one hand you have a shadow prostitution industry, that involves yellow pages ads, internet soft-core porn of escorts exposing themselves and using euphamisms and abbreviations that could have ambigious meaning when describing their services.

You can go to any public library here, and find magazines that list escorts for hire, craiglist, and number of other places.

However, police here have made arrests on so called Asian Massage parlours, if they are setting up shop in the wrong neighbourhoods and people start complaining - and other street prostitution forms are illegal (i.e. soliciting by client or prostitute for services).

So, as far as prostitution being illegal, it doesn't seem to be illegal, because, even where it is, you can always have 'hidden service descriptors' (i.e. full service = vaginal intercourse, etc....) and then claim, it only was meant for time spent and nothing more.
