For starters, hopefully an *EXTREMELY* small minority here would advocate sex with a minor. Point is, we're all clear this is not something to do, especially the guy who started this thread. He sounds a bit repentative, a good thing.

Now, with that said.. Look at the facts. Even when it's proven in courts that this happened, I don't think it results in hard prison time. We have a first offense. There were circumstances that lead him to believe she was of age (the club). That does not release him from the law. But, this is not a hardened criminal looking to do these things. My understanding is the courts would consider that.

The most important thing from here is for all of us to learn... some 15 year olds are quite sneaky. We all can look at this, and decide for ourselves how NOT to get into this. Life's full of surprises, whenever you can, don't get caught off guard.

If that was true then why would they have a underage looking model greeting them at the house? They even mentioned on the show that they lured the POTENTIAL CRIMINALS online and then used that to set up a meeting so they have HARD EVIDENCE of them actually COMMITING THE ACT. Actually I know people who wrote jokes of killing the current president and they haven't been under investigation with FBI or CIA. Tourching someone to cause serious harm/ intent of killing is a felony, consentual sex on the other hand is ALLOWED if both individual are over 18. If the girl agreed to it and didn't press charges then he has nothing to worry about. Why? because sex like that happens everyday and it's not a mandatory arrest, unless they were caught during the action.

Why the hell would the police waste their time and energy tracking one teenager down by using their limited hackers. They have better things to worry about like illegal immigration and terrorism.

It's different when someone falls into an on-line sting operation, because what is used against you is not what you said on-line, but the police officer's testimony about what you typed to him, and then that you showed up in person to meet.

An Internet post could be used as evidence to get a warrant, but in this case a warrant would be useless.

The friend that told me that she was 15 did that to make me leave her so that she can get with me, the chick that i hooked up with told me herself, that her friend has beem really really liking me and that she wants to get with me, she is jealous that she is been liking me for all this time and now her friend comes in the picture and i hook up with her in less than 8 hrs.

Nevertheless this was still a learining experience and open my eyes, what if she was 15.....oh well from now on ima be lookin out for this high school crazy girls.

But anyway to finish the scary storie im still with her since she is 21, she even took me to the university that she goes to, and showed me her grades and everything so thats definite proof if it wasnt already with the ids and passport. She told me why she likes me , and that a lotta men be trying to get with her every day but she ignores them....basicly she told me all about her and how she feels about me. I got me a dime piece but that sex on the first night makes me wonder.

Anyway all girls are hos to me until proven innocent except my mom.

The system is based on the concept that sex is harmful. If we as a society believe that then we're massivley deviant from where we should be. If on the other hand we believe sex between sexually matured individuals is a simple and beneficial biological function then we should embrace that.

We (as a society) can't make our minds up.

Sex with a minor is a crime regardless of circumstances (though some states now have this "Romeo and Juliet" law for very young men, say, under 23). Mistake, deceit, etc. doesn't matter. Her parents don't matter. Her consent doesn't matter. Just don't do it. Obviously as a practical matter you're better off if no one knows or cares, but as a matter of law the prosecutor can do their own thing and may be locking up the parents too if they don't push the case. The reason they nab you regardless of your knowledge or mistake of fact is to create a disincentive for screwing around with young-looking girls unless you're triple sure what you're dealing with.

Three, mere words can be a crime. They can manifest and intent. They can also constitute the "actus reus" of a crime. They can be used to nab you for "attempt" liability. And they can show criminality related simply to the words themselves, such as in the case of "disseminating indecent material to children." We think this all sucks, but we don't have kids. People with kids who are on juries look at this situation very differently.

PS I'm a lawyer with significant criminal defense experience. To those to whom it applies: quit giving bad legal advice and speculating about what will and won't matter legally at trial if you're not.
