Here's the thing about Chapter 7 bankruptcy, especially is you are "early retired" ;) - if you keep a lot of cash (preferable invested in the stock market) while at the same time holding unsecured debt (which can, or at least could, be done with low-interest balance transfers), then once you decide to cross the Rubicon, you can live off of that cash, and as well buy stuff that is considered a regular need (including a cheap house in my situation, the official purchase of which I did not 1 hour before signing the official paperwork with my attorney :cool:), and since you already had that cash lying around, it isn't considered bankruptcy fraud like it would if you were to take cash advances before filing. (I should say that you should always be socking away the maximum amount in your 401K/IRA, which is something that you would keep in a bankruptcy OR divorce, LOL.)

Keeping a lot of debt would also be a good idea if you ever got married to a gal with a lot of debt, like student debt, that way you could pay off your debt together. ;) Your retirement account would be YOUR property, not community property. When debt is paid off in a marriage, you don't get your part back. :mad:
What about cash in your bank account? Lets say you have $6,000. Would not the bankruptcy process scoop that out. You need at least some money on your account for yourself? Not sure about other investments or if the laws are the same in Canada. However from what I understand, cash on account is not legally exempt from bankruptcy.

I thought you need some income or exem,pt funds for chapter 7 to make sense or you will end up broke and unable to even pay the trustee. If there are car loan payments and car insurance coming put.of account then that risks the car as well.

The idea is to spend it all before filing for bankruptcy. Go visit the dentist. Get the car fixed. Get the house fixed. Buy necessary household furnishings. Buy a month's worth of food. Pay a month's worth of insurance.

You don't need to worry about paying off the trustee; that's not your problem - it's your bankruptcy estate's problem. You do need to pay your attorney, but that is money that is taken from the pile of money you had beforehand - and oh yes, they ALL demand payment upfront. :) Of course, if possible, it is a good idea to have enough assets to put into the bankruptcy estate so that the trustee get something, as he will probably get pissed off if you leave him nothing. :) He wants to collect his paycheck like anyone else - and if he's satisfied, he's much less likely to be a harda33 about your case.

That is why Chapter 7 would not make any sense for me. Your financial circumstances sound better than mine because at least you had an IRA. IRAs (known as RRSPs in Canada) would need to be at least 1 year in before it's exempt. Any activity done in the eve of declaring bankruptcy can also be suspect (i.e. if you take out a cash advance from a credit card, or if you suddenly buy a bankruptcy exempt-item just before you declare bankruptcy then the act of doing so may be considered fraudulent conveyance.).

Normally what I do when confronted with gigantic debt I can't afford would be to just default on the debt and wait 7 years for the debts to erase from the system and don't sue any collectors who are calling for harassment (i.e. because they could counter-sue for the debt).
I choose differently this time because I just didn't like the idea of collection calls ruining my day or you never know if I may need credit, and a bankruptcy credit may be better credit than a default credit with a tonne of collection activity.

It sounds like we have a different system in Canada. We don't have bankruptcy attorneys, just trustees and they take care of everything.

Some of the principles and semantics sound similar though.

I did not have a proper job when I declared a chapter 13. I did not even expect to make the first payment let alone 3. I was 100% qualified for a chapter 7 but was worried my bank account would be cleaned out if I did that. I dont like the idea of having a bank account totally cleaned out so chapter 13 looked more palatable as I did not have to worry about the first $10,000 payment for one year and could declare chapter 7 anyway if I did not make that payment. Chapter 7 sound like the trustee wants to know your busineds too much while chapter 13 does not care if you just pay the money.
The only amount that gets cleaned out of a bank account is the amount that was in it on the day of the filing. Now, what you would need to do to prove that any cash in that account was not there at that time is to show a paper trail of where the money had come from, such as from a job or an IRA, etc.

I have a female friend that I meet with for drinks now and then. She ended a long term relationship with a guy she'd been seeing for 10 years, and lived with him for two.

She jumped into online dating and the stories she tells me... OMG!!! dudes are so fvcking stupid. She actually has guys flying in from as far away as Toronto to go on dates with her... one took her to Thailand.... another to Vegas.... She's having a great time... and men are spending their money.

She's pretty cool, great personality, lots of fun, but she is at best a solid 7, most would put he in the upper 6 with an above average body. And she has dudes falling all over themselves over her.

That is no surprize because Toronto is the incel capital of the world. When you say men are flying from Toronto then they are already desperate incels to start with. I agree with what else you said but the Toronto part.ia a throw off.

How can they afford to keep flying like that and on top of it how can a relationship even work if they're hundreds of miles away? It would be hilarious when they spend $500 on a plane ticket and the girl flaked and ghosted and didnt show up lol.

Yes, the hearing has all the bankruptcy filers for that week for that district. AIUI, the order is from the biggest debts to the smallest. I was #1 at my hearing.

That is a surprise, I've always had decent luck there... I travel there 3-4 times a year on business. One of my clients is an automotive supplier with a factory in Windsor, and their HQ is in Toronto. The cost of living there is insane and the take home pay is relatively low for costs. The women I'm met there are usually living on top of each other 4 to a 2 BR apt, paying insane money for rent. You would expect something like this with chicks in their early to mid twenties out of college, but I've seen women doing this in the mid 30s in Toronto. They also have a over inflated opinion of their value

I will say they are pretty liberal... strong feminist leaning... it can be hard to get around that if you don't know what you are doing. They key is the not agree with her, and don't argue with her... just let her ramble on until you hit on something in common, build on that and make it fun.
