I sure don't have sympathy for the guy with the big mouth. When you walk up to someone and get in their face, you are spoiling for a fight.

Not waiting to throw the first punch is probably a good idea. He could have thrown it and gotten the upper hand. Or if you turned your back on him, he could have hit you from behind.

It was a tough call, but I can't fault you for taking a man down for issuing fighting words. There IS a "fighting words" defense in court for this sort of thing.

This is true, also your going to want to examine the proper use of force angle. Talk to a lawyer about this, I know for cops force is only excessive when it goes beyond what is needed to defend yourself. An officer breaking a man's arm and neck in a scuffle is not excessive if the officer was afraid for his life and felt that the hostility posed by the other person would esclate into a life threatening situation. Your arguement should be that this big mouth made you afraid for your life and was escalting the situation to a life threatening situation by drawing you into a fight. You acted out of self defence to protect your life, you're in a club, and a stranger starts picking a fight, who knows what he would have done if you did not defend yourself. Now a good prosecutor will take a look at you and say something like you look like a big guy, you look tough, you afraid of my client they guy you beat up. If your dumb enough to say no I can handle him, then your defense that you were afraid for your life is out the window and you lose. Your job is to present a credible image that you feared for your life, you were drawn into a fight by fighting words and that the fight was motivated by the jealousy of another man who saw you having a better time than he was. Thats as much as I can think that will help you, I don't know the matters of the case so the best advice I can give you is get a good lawyer if you haven't already.

If he laid a hand on you, then I can certainly see why you'd do what you did, but a REAL DJ doesn't get bent out of shape by the words of a jealous AFC.
I guess I didn't add that I actually felt like pretty soon this guy would want to start something physical, because I told the twit to f*cking quit f*cking around and that I wasn't in the mood for his sh*t. I tried to resolve it peacefully, I never called him any names, just plain and simple told him to f*ck off! But drunks are drunks and they are too f*cked up to comprehend.

I didn't just knock this guy to next sunday over nothing. I'm not a violent person, but when I end up in a situation where I feel like I must defend myself, I'll do it very violently......

And plus I called the chicks and they said I did more of a favor to the rest of the girls that are regulars there and the club, because he came by there often to try to get laid, and he would always harass people.......I guess I did a good deed for the place.

I still don't regret beating his ass and going to jail for it, I don't think I'll be doing anymore jail time for this bullsh*t..

Sh!t happens, sometimes a mans gotta do what a mans gotta do. I'm the last person that promotes fighting but every now and again you can't back away. If I am gonna commit to the fight, Im like Colin Powell. Don't try to match force but over match the force, overwhelm it with power, kill its will to fight, make it submit quickly in the face of obvious defeat, and if it still chooses to fight kill it quickly and decisively.

There are also those days that are just the wrong days for someone to start sh!t. There are times when things happen, and on any other day you would not have had two thoughts about walking away, but a bad mood combined with sum alcohol pushes you over the edge. I know I've been there too.

A little off topic but I want to comment, don’t take this as legal advice but perhaps you may learn a few things and/or may make you think a little harder before you enter into mutual combat. I can assure you, you would not want to enter combat with myself.

Although I am not a lawyer I do study the law and use of force and can comment somewhat on this area. First of all much of that stuff with regards to legally using force is out the window if it is a mutual battle. If one party is the aggressor and the other would like to get the heck out of dodge but can't then use of force comes into play.

Generally speaking 2 types of force exist

force and lethal force

Generally when you hit someone it is considered force, if you were to hit them in an area likely to kill them or cause grave bodily harm it is considered lethal force, regardless of whether they live or die. From a legal point of view hitting someone in just the right spot is no different than shooting them. Hitting someone with a bottle is borderline.

Often when I go out (not always) I carry a strong pepper spray with me. If I believe I am legally justified to use force I may choose to spay the other party, this isn't the best thing but hey a lot would have to happen for me to get to that point.

As far as the police using force is concerned, laws regarding force change a little.

An ordinary person generally may use reasonable force, whereas an officer of the law may use necessary force.

Two parties get into a fender bender and one party gets belligerent to the other and gets in his face, the party that at this point is not the aggressor restrains him. This may be considered battery.

Escalation of force

Most of the time things start verbally and that is where they should end. You can use verbal commands as a first line of defense but you shouldn’t shoot someone who is verbally aggressing you. You also don’t need to wait for a person to harm you before you are legally justified in using force. You always want to deal with the threat using the least harmful method, then go from there as needed.

Disparity of force

3 attackers on 1 person, this is what is known as disparity of force. Generally speaking a woman always has disparity of force when a male attacks, regardless of the sizes. An attack by 1 male to another may generally be considered force whereas an attack by 3 males to one male may raise the force level to lethal force. It is reasonable that if an attack persist 3 attackers will cause death or grave bodily harm to a single male, in this situation the person being attacked is justified in using lethal force (he can start shooting). As long as he doesn’t hit an innocent party or property he may legally apply lethal force to any one of the attackers or all of them.

Any time you apply force, lethal or not you only do it until the threat that caused you to take action is gone.

What works for me in those situations is buying the ******* a drink and believe it or not, becoming his buddy for the night. Why you ask? Consider this, this drunken ******* sitting next to you can actually make you look better without any extra effort on your part. ;)

That's why I was never really into the whole bar scene. There's always so many drunk hotheads around. People don't think when they are drunk.

Once I was at a bar and some drunk dude was causing a scene with me. He goes to tackle me and I casually swept his foot and tripped him, and he fell onto a table so hard he broke it. To everyone else watching it didn't even look like I did anything. It looked like he tried to tackle me and tripped. Then I walked over to this guy and asked if he was ok, and extended a hand to help him up. Guy gets 86'd from the bar for acting like a sloppy drunk and falling all over the place. I don't appear to be the agressor, and everyone goes on about their business.

Another time I pull up into a parking lot, in a bad mood, probably looking like I was looking for trouble. 4 gang member looking dudes get out of the car next to me and the "leader" asks me if I think I'm tough. I tell him that's the problem these days, everyone's tough, everyone's a bad a$$ mofo, but nobody is tough enough to love one another. We're all brothers blah blah blah and after about 30 minutes laying a serious mind fvck on this guy, I told the gang members I had to be somewhere, said it was nice meeting them, got in my car, and drove away peacefully.

Violence sucks. People that are violent suck. Violence can be avoided 99.9% of the time, and even when it's needed it should only be applied with the minimum force necessary. Most violent people are weak, meaning they can only make their point with their fists. So the next time you think about putting the beat down on somebody, try seeing that person for who he really is, a frightened little boy, and instead of pounding him, pity him.

Weed is much better than alcohol. It doesn't interfere with your ability to drive, doesn't slow your reaction times and doesn't turn you into an instant a-hole.
