Question for my legal experts and lawyers on here this is my current situation!

Arrested last year mid November official charge was neglect against an elderly person that elderly person was my mother who has recently passed away. They said I failed to provide proper care for a wound for months when in fact I did and the wound was only around for a couple of days. Since being arrested i've had to go in front of the judge four times the last three times via zoom . The next time I have a court date will be February 6th i've consulted with several lawyers all will take the case for minimum $5,000 to upwards of $25,000 to represent my brother and I. I will be 40 years old this month and have no criminal record neither does my brother just wanted to know what has been your expensive situation like this I know everyone's different I just want some input on somebody who's been there or is a lawyer . Thanks ahead of time!

What exactly are you asking? Whether or not you should hire a lawyer? Yes, you definitely should, even though it's not going to be cheap. If you try to represent yourself, you will get railroaded.

No damage I know it never is cheap you pay for it either with cash or time just want to know what have been your experience?

I don't think you'll find anyone here who's been charged with neglect of an elderly person. It's not a very common offence.

Exactly what evidence are they presenting against you?

It seems very strange to be honest.

There are a lot of good legal forums that have lots of attorneys answering these type of questions, you would get a lot better responses asking on there, which is the proper forum for such a question, not on here.

That is so hard. Your mother died and that is traumatic enough, and to be charged on top of that. It sounds very wicked and personal.
You are not allowed to grieve but have to deal with this BS on top of that. That just sounds so evil. Have you spoken to any grief counsellors about this? Whatever you do, look squarely in the eye of the jury/judge or whomever, get upset with this and say how dare they accuse you of this. Put passsion and conviction and defend yourself and put these people to shame for making such a ruthless and sick misuse and abuse of court process resources and time.

Practise what you'll say with a lawyer and sell yourself to the court that you wouldn't even think of doing such a thing they are charging you with!

Your moment will come and you will seize the day when its time to show up in court. You are the event. Own this.

I'm an amateur part-time lawyer. My advice is to sing to the judge "zoom zoom zoom, we're going to the moon" and then plead insanity.

Not legal advice because I am not a Florida attorney and cannot give advice.

Without knowing the evidence, if it was in a jurisdiction I am licensed in, it would look like a good case to take to trial because the primary witness is deceased, much of the evidence would qualify for hearsay and require some exception to allow its use at trial, criminal negligence generally requires a gross breach of a duty of an ordinary duty of care that you dont have as a non-medical person, both caretakers can plead the fifth in each other's trials due to simultaneous charges, and the wound appearance timeline could be potentially proven by expert medical witnesses on your side. Plus, you have no criminal record and might be willing to risk a trial to keep it that way.

That is probably why they are charging so much. Attorneys charge more if they think the case is going to trial.

Public defenders are not necessarily bad in a trial scenario. The issue here would potentially be making sure that they hire a good expert witness using their limited budget.

I don't know the evidence and I am not licensed in Florida, so I really can't advise you on how Florida law would fall on these issues or which issues there ultimately will be.
Oh and one thing I left out she was going to a clinic here south Florida on weekly basis and I mentioned as well that I don't have a criminal record.
