I have cox cable. They provide me with internet cable, calbe tv, and telephone service which I pay for monthly. They way they have it set up is that they bill you in advance. They send out a bill on the 22nd for the upcoming month and you are required to pay that within 7 days or what not.
So about 3 weeks ago I come home. My internet cable is down, my tv is turned off but my phone is working. I call up cox cable and they say I owe them 400+ dollars and to turn it back on I need to make a payment. I say to them, but ive already sent in a check 2 weeks ago, you didnt recieve it? They say no and that I can pay them online via debit card. Now normally i would log on to the internet and check my online bank statement but since i dont have internet i cant do that. I admit im not very good at keeping track of my checking needs. Anyways I agree, and pay them the full amount I owe them which was like 457$.
The next day I go to my bank and see that the check i sent them has been cashed. I call cox immediately and say I have been charged twice. They say they havent recieved it, nor is it credited to my account. I bring in a copy front and back of the check they cashed to their mani office. They say it was probably deposited into someone elses account and that it will take about 1 week for their account people to find my money and then they will send me a check back.
A week goes by and I hear nothing from them. I go into the office again and speak with the lady I spoke with the first time. She tells me to stop coming in and that she will call me in a few days when she hears something. Now another week goes by and I call the same lady and she says they are looking into it, this takes time. So now its been 3.5 weeks, I have heard nothing and every time I call they transfer me to an automated machine which gives me the same stupid options every time.
Now im wondering what my options are. Is it too early or is it even worth it to start thinking about a lawyer? Should I wait longer for my money? What do you think is a reasonable time frame for me to get my money back seeing as how it was their mistake.
