I need to get a business patent, how do I go about doing that?

From what I've heard from inventors and patent holders (whom I'm around on a daily basis) don't get a patent unless it is a million dollar plus idea.

The cost of a patent attorney (which you DO need if you truly want to make money off it) the actual patent, keeping it current, etc. is higher than most think.

If you don't think it is worth a million dollars, don't patent and just start making it. When you start making a good amount of money from it, then people will start to take notice. By that time you'll have prior art, and even if they manage to start competing you'll already have a good amount of cash.

My dad is a patent attourney.

He always recommends someone to do their own personal research before coming to him. So, start reading on the net about how to go about filing a patent, then hit the phone book and find 5 patent lawyers, phone them up and decide which one you want to deal with. Go meet with them and present your case, see which one has the most experience with your type of product, and go with him/her.

That's pretty silly. That sounds like fear. I see where you're coming from though. The logic in this is: Don't patent an idea unless you already have a game plan for it. In other words, know EXACTLY what you intend to do with your patent down to the fine details, before you spend anything on it.

What's a very rough breakdown of average fees? I remember looking into this once and I think it was over a thousand a year just to maintain a patent, assuming you get one.

Before you get any ideas have you done a thorough patent search?

If you haven't you should anyways since reading them will give you an idea about the structure and necessary contents if you decide to write your own.

Also there are multiple types of patents and each has different expiration dates and initial costs associated with them. Take the time to learn each type and the laws that correspond to them.

Most of what a patent attorney can tell you upfront can be found on the us patent and trademark website. Thing is that you will have to spend weeks or months to actually get a grasp on all of it.

I dont know what you intend to patent so I really cant say whether or not it is feasible for you to start making it without a patent. That also depends on what sector it is in, but legal fees can be reduced if you know your back story before talking to a lawyer.

Roughly over thousand bucks for your basic product patent, I'm assuming that is your business idea.

I'll throw some questions at him tomorrow and get some lowdown on it.

Ok so I talked to my dad about it today, he told me that people get patents for INVENTIONS. My idea isn't an invention but more of a really great idea. Up until today I only told my g/f but I told my buddy the idea (known him for 8 years) and he was floored about how great the idea was. SO do I need to get a patent for an idea or for inventions. Oh btw, if all goes well, it will make me A LOT of money. Once it gets rolling, I'll let you guys know what it is.

but before all that be shure that your idea is uniqe....

many people have thought up ideas that they believe were new and uniqe and later on found ot it has been taken by someone else....

I dont understand why they would make patents so hard to get. $1000/year?
that'll discourage prospective inventors.

No, it will make sure that the people who go for patents actually intend to use them. Well, it was started that way. Now $1,000 is penny change for some people/corporations. I really think they should raise it, theres too many superfluous patents out there.

the patent itself isn't that expensive.. if i remember correctly like 200-300 bucks.

to have a patent and to know that is always current and to make sure it fully protects your best interest, which is why you want a patent in the first place, it's going to cost you, at least it did us, a couple of grand a year. it's been a couple of years but we had 5 patents that costs us in all about 7 grand a year. HOwever, our compaines bread and butter was that patent, and to make sure we could feed our mouths, it's money well spent
