Getting asked to leave the apartment by manager/landlord

Hi fellas. I'm 21 and still live at home with my parents. However, our apartment keeps having a lot of problems like ceiling is broken or whatnot and people are always coming in to fix it. One of the guys whos not the landlord but sort of like the manager talked to me and was trying to convince me to tell my parents to move out of the apartment. He said he would pay 20K if we leave the apartment and find another place to live. Note, we live in NYC and its an okay neighborhood... not really good but not really bad.

The thing is my dad had this apartment for about 28 years already. Because of something in the contract, our rent only goes up once every 2 years. We have 3 bedrooms, 1 bathroom and 1 kitchen and our rent is about 650 dollars. Yes 650 dollars. It was about 500 dollars like 5 years ago and now went up only to 650. I know similar apartments if you find one now in NYC with 3 bedrooms will be 1800 dollars or so. My parents will not move because they don't have enough money to buy a house. HOwever, if we go to find another apartment thats 3 bedrooms in new york, it will cost at least 1500 minimum.

I know this manager wants us to leave b/c he wants this apartment repainted and look better so they can get another person to rent it and probably pay around 1800 a month instead of receiving only 650.

Is this illegal of what he is doing? He even offered to pay me 5 grand if i can convince my parents to leave the apartment. I am sure that is illegal right? They are doing this obviously because our rent is way too cheap and they can't do anything about it and would like to rent it to someone for 1800 a month.

Are you ****ing serious? You pay $650 a month for a three bedroom in Manhattan? A good part of Manhattan? You can't even get a studio for that much!

it's not that good? It's okay. My dad said he is not going to leave.

My question is can the landlord legally do this?

whether it's illegal or not, I don't really see why you have a problem with it. He's not doing anything offensive by making you an offer. Man up, dude! Don't be a p*ssy who takes offense at the slightest suggestion. If you don't want what he offers, learn to say no and stand up for yourself. Have you learned anything from this website?

(and no, I doubt it's illegal)

sure he would like to talk you into moving so he can repaint it real cheap and re-rent it for 3 times the money per month.
but he can't force you if you have a contract, he isn't threatening to evict, he was just trying to talk you into it.
i don't think it is illegal to talk to you, and i think your reaction to stuff like this should be more on the lines of "are you kidding, we love it here ! "

yea and also they wouldnt move out since 650 is real cheap for a 3 bedroom aparmtnent. You cant find one in nyc this cheap because you cant even find a studio this cheap. 3 bedrooms are minimum 1800 dollars.

What he did is no more illegal than offering a guy on the street $200 for his bicycle. As long as he's not withholding services that he is legally responsible for (i.e. maintenance, utilities) or trying to coerce you through threats of violence or intimidation then there's nothing wrong with what he is doing.

What's going on is called "rent control". It means that the rent can't go up (or if it does, minimally) on certain properties, as long as the renter or any members of his family live there. He is well aware that he can get much more money for your unit if a new person moves in, and he's trying to entice you into leaving your place for a quick monetary gain... since he's the landlord, if he makes $1000 more a month, he'll have regained his 20k (and then some) within the course of just 2 years... and then he'll start making serious profit thereafter (compared to what he makes off of you, which is probably a loss).

What I'd do is tell him that you'll be glad to take a non-refundable deposit of 3k from him just to talk to your parents about it, with no guarantees, and if they do move out then he can give you another 2k. That way you make money without having to do a single thing.

End result? What he's doing isn't illegal. Hell, it isn't even immoral. It's a short term expenditure that will net long-term profits.

Get a mortgage, and pay mortgage for 28 years... If you can hustle you can pay it off in 10 years. At the end the appartment is YOURS!!!!!!!!

I feel you dude. I'm also live with my family. I'm 17and my family isn't exactly rich, we're between poor and average. We also rent, but we pay almost triple your rent.

Our landlord is also kicking us out (She is an old power hungry lady). She didn't even offer reimbursement for leaving. She sends a lawyer to give us a 90 day notice of evacuation or our belongings will be moved.

We got a lawyer and stuff, but we couldn't walk away with any money. In a few months, we gotta go too!!

God i hate that ugly ***** lol.

As for you, you don't need to move. In my city (SF), a tenant can only be kicked out through OMI or EMI. (Owner move in), i forgot the ohter one. If that is the case, each person leaving will receive 4500 US dollars.

A lot of tenants will try to persuade ppl to move by giving them money, like what yours is doing. So the moment you move, the landlord is not reliable. And if you take it to court, he/she can claim "you volunteered to move out".
