Calling All Lawyers!! Legal Advice Anyone??

Here's the story. I purchased a hands free cellphone device that installs into your car. Parrot CK3200. Basically what this devices does is connects to your radio, and using bluetooth technology, anytime your phone rings, it mutes the radio and you hear the conversation through the cars speakers. There is a mic that mounts on the sun visor or something.

So I purchase this product from CellHut.com. I read over everything and Parrot recommends that you get this product professionally installed. So, I call up a couple of places I know and get estimates. They all say $150 for installation. So I go to the one I think is the best. We talk things over and they get an idea of where I want this thing mounted.

Later I get a phone call saying that they had a problem installing the product. The product has power, but nothing appears on the screen. My phone doesn't recognize that it's even there, but find another bluetooth product that's in their lobby area. They ask me what I want them to do, so I call CellHut. CellHut says that I should return the product to them. Everything. So I tell them to pull everything out and pack it back in the box.

So I go back to pick up my vehicle, they explain everything to me again, and say "That'll be $120 for parts and labor". I'm floored. I can't believe they would actually charge me for something I don't even have in my car. At the sametime I understand that they did a job. Regardless if it works or not is on me. If I had bought the product from them, then that would be a different story.

I call CellHut and explain the situation to them. They tell me to take the problem up with the installers. The installers say take the problem up with the people you bought it from. So I'm back and forth. I finally get a supervisor on the phone from Cell Hut and they tell me they will exchange my product, but will not refund me the $120 for installation. He then tells me to contact the manufactorer.

I call up Parrot and they're saying that they can't believe that the installers wouldn't do another installation if I brought them a product that worked for free. They also say that they're not gonna foot the bill.

I ended up making a complaint against CellHut on Better Business Bureau. Not sure where that's gonna get me. I also called some guys down at the smalls claims court. Turns out since the company is in NY and I'm in CA, I would probably end up paying a lot more money than $120 for filing and crap. Then even if I did win, I would have to pay more money for NY to even recognize the fact that I won in CA.

It sucks that companies can just get over on consumers like this. I pretty much simply have to bite this bullet. Take it in the butt. Bend over and get fu$ked. No lube and no kiss goodnight. Not even a reach around. You get the picture.

So I'm asking all lawyers/legal advisors/attorneys for some advice on sticking it to the man!!

The bottom line is the installer is entitled to compensation for the labor they put forth.

It sucks for you. But he did the job you asked.

The guys are right. They did there job and they should be paid for it regardless if it worked or not. Just drop it. Even if you do win you probably end up spending a lot more money and a lot of time for 120 dollars.

Yanno, in all honesty, the advice you gave in that post, I agreed with. She obviously was trying to get under my skin, and it did work. It pissed me the hell off and I lost my cool completely.

But when some guy comes and TELLS me that I actually go out to meet women without thinking that I wanna meet women, and that I actually HAVE to talk to hot chicks, in order to have a good time, is pretty stupid and I honestly don't think that what every "Moderator" and "Master Don Juan" says is golden unlike the majority of the guys on this site.

True, some of you have some good advice and a lot of it makes sense, but others, it seems like you all continued to post and post until you made it to a certain status and now you feel that you are god to the world and knowledge of women. I pick and choose which advice I wanna listen to, and when the advice given is b/s, I'm gonna call it. I would hate for some other guy to come along and read crappy advice from one of my threads and take it as gold, when it's actually brown crap floating in a pool of stupid.

If you decide that you don't wanna offer me advice anymore, then so be it, but I'm sure there are others on this site that feel the same way I do when it comes to taking advice on this site.

I agree with you all on the fact that the installer should get paid for his work. I'm definately not saying that he shouldn't.

I do think that the company that sold me the item should foot the bill though. I talked to a couple of lawyers and they all said the same thing. The company is based in NY, and I would be filing in CA. If they didn't show up then I would win by default, but then I would have to do more paper work (money) to get the people in NY to agree and make the company pay.

Court cost would be part of the suit, so whatever money I spent to get back the $120 should also be covered.

I am not a lawyer and do not intend to play one on the Internet, but if you did sue, the first thing that your lawyer would due after writing the complaint, before filing it, is to mail a copy to the would-be Defendant. It's a scare tactic, and it often works. A cover letter is usually included that says, 'here's the papers I'm going to file to sue you in court. Contact me before ___ so we can resolve this and avoid litigation. If I don't hear from you by ___ I will file this complaint and you will receive the formal court summons shortly thereafter." Sometimes they get scared and cave right away. 99.9% of people don't know how to write their own complaint and do this, but it's just a fill-in-the-blank legal form document. You could write one in a couple hours by visiting your local law school's library and asking to see the form books.
